Terms and Conditions of Sale

This English version is provided for convenience. In the event of any discrepancy, the French version shall prevail.

1. Seller identity

The website is operated by MPCC, a French single-shareholder simplified joint-stock company (SASU), represented by its President Maxime Pernin, whose registered office is at 1 place des Poilus, 31590 Verfeil, France (hereinafter "Sculpta Swim").

2. Purpose

These terms and conditions of sale apply without restriction or reservation to all online sales offered by Sculpta Swim on the website www.sculptaswim.com.

The Site is an e-commerce platform allowing customers to purchase fashion items, including sculpting bodysuits, shaping swimwear and related accessories (the "Products").

3. Acceptance of the terms

Placing an order on the Site implies full and complete acceptance of these terms and conditions of sale. Buyers who do not accept these terms must not place an order.

4. Products

The products offered for sale are those shown on the Site, while stocks last. Product photographs and descriptions are provided for information only.

Sculpta Swim reserves the right to change its product range at any time.

5. Prices and payment

5.1 Prices

Prices are displayed including all applicable taxes, in the currency shown on the Site. Sculpta Swim reserves the right to change its prices at any time. The applicable price is the one displayed when the order is confirmed.

Any shipping costs are shown before the order is confirmed.

5.2 Payment methods

Payment is due at the time of ordering. Accepted payment methods are:

• Bank card (via Stripe)
• PayPal

Sculpta Swim reserves the right to suspend any order in the event of a payment issue or attempted fraud.

6. Shipping

Delivery time varies by destination country. Estimated delivery times are shown at checkout.

In the event of a delivery delay, buyers can contact customer service at contact@sculptaswim.com.

Sculpta Swim cannot be held responsible for delays caused by carriers or external circumstances (strikes, bad weather, etc.).

7. Right of withdrawal and returns

7.1 Right of withdrawal

In accordance with articles L221-18 et seq. of the French Consumer Code, the buyer has 14 days from receipt of the products to exercise their right of withdrawal, without having to give a reason or pay any penalty.

To exercise this right, the buyer must notify Sculpta Swim of their decision with a clear statement, by email to contact@sculptaswim.com, stating their order number and the item(s) concerned, before sending anything back. A model withdrawal form is attached to these terms.

7.2 Conditions

To be eligible, the product must be:

• unworn, unwashed and unused;
• in its original condition, with all its tags;
• accompanied by the order number or proof of purchase.

Items bought on sale benefit from the right of withdrawal under the same conditions as full-price items.

7.3 Return procedure

1. Contact customer service at contact@sculptaswim.com stating the order number and the item(s) concerned.
2. Wait for confirmation from Sculpta Swim before sending the product back.
3. Return the product to the following address: Sculpta Swim — Returns Department, 1 place des Poilus, 31590 Verfeil, France.

Products returned without prior approval will not be accepted.

7.4 Return costs

Return costs are paid by the buyer. A tracked shipping method is recommended: without proof of shipment, a lost parcel cannot be refunded.

7.5 Refund

In the event of withdrawal, Sculpta Swim refunds all amounts paid, including the initial standard shipping costs, no later than 14 days after being informed of the buyer's decision to withdraw. Sculpta Swim may, however, delay the refund until the products have been received, or until the buyer has provided proof of shipment, whichever is earlier.

The refund is made to the payment method used for the order.

7.6 Exchange and store credit (alternatives)

Instead of a refund, the buyer may choose:

• a size or product exchange;
• a store credit voucher equal to the value of the returned item, valid for 12 months.

In both cases, the cost of returning the original item is paid by the buyer; shipping of the replacement item is free, paid by Sculpta Swim.

8. Legal guarantees

In accordance with applicable law, the buyer benefits from the statutory guarantee of conformity (articles L.217-3 et seq. of the French Consumer Code) and the statutory guarantee against hidden defects (articles 1641 et seq. of the French Civil Code), as well as any mandatory consumer guarantees in their country of residence.

If a product is faulty, damaged or does not match the order, the buyer should contact Sculpta Swim at contact@sculptaswim.com with photos of the defect. In this case, return costs are fully covered by Sculpta Swim, which will replace or refund the product.

9. Liability

Sculpta Swim makes every effort to ensure the availability and proper operation of the Site. Sculpta Swim cannot be held liable for indirect damages, data loss or commercial losses related to the use of the Site.

10. Intellectual property

All content on the Site (texts, images, visuals, logos, trademarks) is protected by intellectual property law. Any reproduction or use without prior authorisation from Sculpta Swim is strictly prohibited.

11. Personal data

Sculpta Swim collects and processes its customers' personal data in accordance with the General Data Protection Regulation (GDPR) and the French Data Protection Act. For more information, please see our Privacy Policy.

12. Mediation

In the event of a dispute, the buyer may use a consumer mediator free of charge:

13. Governing law

These terms and conditions are governed by French law, without prejudice to any mandatory consumer protection provisions of the buyer's country of residence. In the event of a dispute, the French courts shall have jurisdiction, subject to those mandatory provisions.

14. Changes

Sculpta Swim reserves the right to change these terms and conditions at any time. The applicable version is the one in force on the date of the order.
